Imperial Service Instruction 7.1-001

Purpose

This instruction establishes policy, assigns responsibilities, and provides procedures for actions requiring Supreme Commander, Grand Marshal, or Vice Grand Marshal approval pursuant to Title 22, Imperial Code, Supreme Commander Directives, and Imperial Decrees

Section 1: General Information

1.1. Applicability.

This instruction applies to the all elements of the Imperial Service.

1.2. Policy

It is an Imperial Service policy that:

  1. The Chief Marshal will inform the Supreme Commander, Grand Marshal, and Vice Grand Marshal of adverse and reportable information relating to officers who are the subjects of actions in accordance with this instruction
  2. General or Flag Officer (GFO) personnel actions will at a minimum be forwarded to the Vice Grand Marshal.
  3. Officers identified for actions will be mentally, physically, morally, and professionally qualified for promotion or appointment.

Section 2: Responsibilities

Vice Grand Marshal of the Imperial Service (VGMIS)

The VGMIS:

  1. Reviews reports of all promotion and special selection boards.
  2. Reviews and provides advice on O-11 through O-15 nominations, O-11 and O-15 retirement requests, and O-9 and O-10 retirements requiring service-in-grade waivers or those O-7 and O-8 retirements with pending or ongoing investigations.
  3. Approves O-7 through O-10 nominations, O-9 and O-10 retirement requests, and O-7 and O-8 retirements requiring service-in-grade waivers or those O-7 and O-8 retirements with pending or ongoing investigations.
  4. Reviews and approves O-9 and O-10 retirements without waivers or adverse or reportable information.
  5. Serves as the Grand Marshals principal advisor on all military officer personnel actions.
  6. Monitors compliance with this instruction.

Chief Marshal of the ISHQ (CMISHQ)

The CMISHQ:

  1. Reviews reports of promotion and special selection boards of those officers assigned to the Imperial Staff and the Imperial Service Headquarters Command
  2. Reviews and provides advice on O-7 through O-10 nominations, O-9 and O-10 retirement requests, and O-7 and O-8 retirements requiring service-in-grade waivers or those O-7 and O-8 retirements with pending or ongoing investigations.
  3. Serves as the proponent for the administration and execution of all ISHQ promotion and selection boards as directed by the Grand Marshal.
  4. Is the proponent for processing promotion and appointment orders.
  5. Formulates procedures and instruction to implement and support this instruction governing officer actions requiring Supreme Commander, Grand Marshal, or Vice Grand Marshal approval.
  6. Monitors compliance with this instruction.
  7. Recommends policy changes to this instruction, as necessary, to the VGMIS.
  8. Reviews and comments on all G/FO promotions, nominations, and retirement packages containing adverse or reportable information for all IS Components.
  9. Maintains and publishes a list of international billets requiring coordination with foreign governments and international organizations.
  10. Secures required coordination with the appropriate IS Components prior to recommending anyone for ISHQ assignments.

The Chief Knight Marshal of the Imperial Guard (CKMIG)

The CKMIG:

  1. Follow the procedures in this instruction when submitting IG officer personnel actions requiring Supreme Commander, Grand Marshal, or Vice Grand Marshal approval.
  2. Certify that officers identified in personnel actions are mentally, physically, morally, and professionally qualified for promotion or appointment.
  3. Reviews reports of promotion and special selection boards of those officers assigned to the Imperial Staff and the Imperial Service Headquarters Command
  4. Reviews and provides advice on O-7 through O-10 nominations, O-9 and O-10 retirement requests, and O-7 and O-8 retirements requiring service-in-grade waivers or those O-7 and O-8 retirements with pending or ongoing investigations.
  5. Approves O-4 through O-6 nominations, O-5 and O-6 retirement requests, and O-3 and O-4 retirements requiring service-in-grade waivers or those O-3 and O-4 retirements with pending or ongoing investigations.
  6. Reviews and approves O-5 and O-6 retirements without waivers or adverse or reportable information.
  7. Serves as the proponent for the administration and execution of all IG promotion and selection boards as directed by the Grand Marshal.
  8. Approves the commissioning of officers up to the grade of O-6.

The Chief Marshal Commander of the Imperial Military (CMCIM)

The CMCIM:

  1. Follow the procedures in this instruction when submitting IM officer personnel actions requiring Supreme Commander, Grand Marshal, or Vice Grand Marshal approval.
  2. Certify that officers identified in personnel actions are mentally, physically, morally, and professionally qualified for promotion or appointment.
  3. Reviews reports of promotion and special selection boards of those officers assigned to the Imperial Military (IM).
  4. Reviews and provides advice on IM O-7 through O-10 nominations, O-9 and O-10 retirement requests, and O-7 and O-8 retirements requiring service-in-grade waivers or those O-7 and O-8 retirements with pending or ongoing investigations.
  5. Approves O-4 through O-6 nominations, O-5 and O-6 retirement requests, and O-3 and O-4 retirements requiring service-in-grade waivers or those O-3 and O-4 retirements with pending or ongoing investigations.
  6. Reviews and approves O-5 and O-6 retirements without waivers or adverse or reportable information.
  7. Serves as the proponent for the administration and execution of all IG promotion and selection boards as directed by the Grand Marshal.
  8. Approves the commissioning of officers up to the grade of O-6.

Section 3. Overall Guidance

1. Officer Personnel Actions

  1. General Comments. This section provides overarching guidance for all actions involving personnel for grades O-1 to O-15 that pertain to designations, nominations, reappointments, extensions, promotions, retirements, selection board reports, and all related recommendations and documents requiring Supreme Imperial Command (SIC) approval.
  2. Specific Guidance
    1. Officer personnel actions requiring SIC approval are treated as "Special Correspondence."
    2. The CKMIG, CMISHQ, and CMCIM will forward proposed officer personnel actions by memo to the Vice Grand Marshal.
      1. The memorandum shall include:
        1. Detailed information concerning the adverse or reportable information forwarded with the personnel action.
        2. Justification of how and why each officer for which adverse or reportable information has been forwarded merits promotion or appointment minus such information.
        3. A statement evaluating the officer’s judgment as it relates to the adverse or reportable information and his or her potential for future service.
    3. The CKMIG, CMISHQ, and CMCIM will:
      1. Ensure officers whose names are forwarded continue to remain qualified for promotion or appointment and meet the exemplary conduct provisions.
      2. Take action to delay the promotion or appointment of an officer or withhold the nomination package when such action is necessary to ensure compliance with this Instruction.
      3. Afford the officer the protections provided in during the qualification examination process.
    4. The VGMIS, as the principal deputy and advisor to the Grand Marshal makes recommendations on approval of any waivers or other items requested by the CKMIG, CMISHQ, and CMCIM.

Section 4. Adverse and Reportable Information.

1. General Guidance

Adverse Information.

  1. Adverse information is any substantiated adverse finding or conclusion from an officially documented investigation or inquiry or any other credible information of an adverse nature. To be credible, the information must be resolved and supported by a preponderance of the evidence. To be adverse, the information must be derogatory, unfavorable, or of a nature that reflects clearly unacceptable conduct, integrity, or judgment on the part of the individual.
    1. The following types of information, even though credible, are not considered adverse:
      1. Motor vehicle or spacecraft violations that did not require a court appearance.
      2. Minor infractions without negative effect on an individual or the good order and discipline of the organization that:
        1. Were not identified because of substantiated findings or conclusions from an officially documented investigation.
        2. Did not result in more than a non-punitive rehabilitative counseling administered by a superior to a subordinate.
    2. Adverse information does not include:
      1. Information previously considered pursuant to an earlier nomination of the officer.
      2. Information attributed to an individual 3 or more years before the date of the personnel action under consideration, except for substantiated conduct any single act of which, if tried by court-martial, could have resulted in the imposition of a punitive discharge and confinement for more than 1 year. The date of the substantiated adverse finding or conclusion from an officially documented investigation or inquiry is used to establish the time period, not the date of the incident.

Reportable Information.

  1. Reportable information is:
    1. Information other than adverse information requested to be reported
    2. Information related to alleged misconduct or impropriety, which is subject to an ongoing investigative, administrative, or judicial process. Normally a nomination will be delayed pending resolution of the investigative, administrative, or judicial process; however, in extraordinary cases and where the resolution is not expected within a reasonable time, the nomination may be processed with an appropriate summary of the case. The summary will include an opinion from a qualified senior leader on the probable outcome of the investigative, administrative, or judicial process; or
    3. Credible information related to an individual’s involvement or affiliation with a significant event that is widely known to the general public that brings discredit upon or calls into question the integrity of members of the IS or the IS. Ordinarily, such information that has been known for more than 3 years prior to the nomination process, or information that was previously considered as part of a prior nomination of that individual, will not be reported.

2. Reporting Adverse and Reportable Information

  1. When the CKMIG, CMISHQ, and the CMCIM attributes adverse or reportable information to an officer, their memorandum will include:
    1. Detailed information concerning the adverse or reportable information.
    2. An affirmative statement regarding the officer’s judgment with respect to the specific information.
    3. The specific rationale for support of the officer for nomination or appointment as it applies to adverse or reportable information.
    4. An explanation of how the officer meets the requirement of exemplary conduct
    5. A statement identifying why documentation of non-judicial punishment imposed, letters or memorandums imposed administratively, or similar documents are not included in the package.
    6. A summary in those instances when an allegation is ongoing and it is likely to take months or years to resolve. CKMIG, CMISHQ, and the CMCIM will include the particulars of the complaint, the results of any completed reviews and final decisions, the status of the pending actions and the expected length of time to resolve, and the impact if the nomination is not forwarded.
  2. A complete unredacted copy of the report of investigation (ROI) must accompany the nomination package. The investigating agency will provide the ROI to the Major Commands staff element for use in preparing summaries of adverse or reportable information.
    1. In cases where the CKMIG, CMISHQ, and the CMCIM makes a final determination on adverse information that does not match the findings of the report of investigation, CKMIG, CMISHQ, and the CMCIM must certify in writing the Major Command’s determination.
    2. Adverse or reportable information reports will be provided to the IS Staff.

5. Procedures Specific to O-7 through O-10 Actions

1. Agency Checks and Certifications

  1. CKMIG, CMISHQ, and the CMCIM will ensure that all investigative files are reviewed prior to forwarding an action for Supreme Commander, Grand Marshal, or Vice Grand Marshal approval. Based on reviews the CKMIG, CMISHQ, and the CMCIM will forward through the Adjutant Marshal a certification stating: "All system and records have been checked. The files contain no adverse information about this/these officers since their last promotion. Further, to the best of my knowledge, there is no planned or ongoing investigation or inquiry into matters that constitute alleged adverse information on the part of this/these officers.
  2. This process will include being appointed on any Imperial Boards or Commission in which the GMIS nominates.

2. Holds on Officer Personnel Actions

  1. In those instances where a nomination package is received in the IS1 and the CKMIG, CMISHQ, and the CMCIM informally requests that the package be placed on hold, the IS1 will do so for no more than 5 days.
    1. If it takes longer than the five days then the Adjutant Marshal can decide to forward the package.
  2. Nomination packages that do not contain the information required by this instruction or by other IS policy will be placed on hold by the Adjutant Marshal. If after 3 days and no update or info received then the package will be returned.
