Module 4 — Application, interpretation, and legal-source discipline

Lessons

4.1 Controlling text and reference material

Students distinguish authenticated controlling instruments from Great Library reference and instructional material. Reference publication assists discovery and education but does not enact, authenticate, register, seal, or codify law.

4.2 Current, historical, reconstructed, and superseded material

Status and provenance must be read before relying upon a source. Historical or reconstructed records can remain important evidence without silently becoming current law.

4.3 Citation and reasoned application

A sound constitutional analysis identifies the controlling provision, describes the relevant facts, applies the provision without inventing authority, and records uncertainty where the source does not resolve the issue.

Final examination

The examination contains:

20 short-answer source and terminology questions;
5 authority-classification problems;
2 constitutional application essays.

Students must distinguish legal authority from reference publication in every problem where the distinction is material.
